6 Essential (Mandatory) Restaurant Licenses in India
These apply no matter how big your place actually is, what you serve, or which city you are in. Think of this as the mandatory list of license required for restaurant operations in India, before you even get to play music or alcohol permits.
FSSAI Food License:
Every business that handles food should have it. The fssai license for restaurant category only depends on your turnover. Under 12 Lac per year you only require a basic registration which costs $100/year and it usually takes up to a week to complete it.
Above 12 Lac per year, your business now requires a State Registration. It costs between 2,000 – 5,000/year. If you turnover more than 20 crore or operate in more than one state you should now have a central license priced at 7,500/year. After the license issuance number must be mentioned on all your bills and also be displayed at the entrance to be checked by the inspectors.
Among the fssai restaurant license documents required, keep these ready beforehand. ID and address proof of owner, proof of premises, NOC, food safety management plan.
GST Registration:
Your registration becomes compulsory once your turnover reaches 20 lakh (some Special Category states can get by with 10 lakh). Registering yourself with the GST Portal is a free process but most owners approach a CA with charges ranging from Rs 1000-Rs 8000 to ensure smooth registration the first time. The process takes about a week. It is Illegal for you to charge GST to your customers on your invoices, should you wish to do so, without a registration.
Shop and Establishment License:
This one applies to how you run your employees: whether working hours, weekly holidays or overtime. Each state has its own Act and you apply via the state labour department. The cost for the licence is 500–5000 while the time taken for processing ranges from two weeks to four. The validity of this varies by state – it can be valid from 5 years to infinity.
Health or Trade License:
Given by the municipal corporation (MCD in Delhi, BBMP for Bangalore etc.) Once they have verified your kitchen has required hygienic and sanitation standards, Cost is based on the seating capacity; for a small cafe between 1,000 to 5,000 otherwise higher cost. It is to be renewed annually.
Fire Safety NOC:
Necessary in any size or greater restaurant, or any that utilize an LPG setup, which almost certainly is every restaurant. If you are using a grill, tandoor, or any smoke emitting equipment. Required by the State Pollution Control Board.
Lift License:
If your place has an elevator for staff or customers, issued by the Chief Inspector of Lifts.
Outdoor Seating Permission:
If you want a table on a footpath or an open terrace. Municipalities check footpath width and public obstruction before approving this, and it often comes with a separate annual fee.
Pest Control Certification:
This is not always legally mandatory, but many food safety officers ask for it, especially if you are near a market or garbage collection point.
Food Aggregator Registration:
